   Welcome to ZetaCircle.com (“the Site,” “we,” “us,” or “our”), a global digital platform operated by ZetaCircle Technologies Private Limited, a company duly registered under the laws of India with its principal place of business at 123 TechPark, Bengaluru, Karnataka, India (hereinafter referred to as “ZetaCircle,” “Company,” or “Owner”). This website serves as a multifaceted digital ecosystem that aggregates, publishes, and facilitates access to an extensive range of user-generated and AI-generated content, including but not limited to: mobile number listings, AI-authored articles and information, AI-powered engagement tools, cost projection models, medical advisories derived from AI analysis, geolocation data, SaaS-based online store creation tools, third-party API integrations, scraped public data, and cross-border commercial services including medical tourism facilitation.

By accessing, browsing, registering for an account, posting content, using any services (including SaaS tools), interacting with AI features, making payments, or otherwise engaging with ZetaCircle.com (collectively, “Use”), you (“User,” “Visitor,” “Subscriber,” or “Client”) expressly acknowledge, understand, and unconditionally agree to be bound by the following Terms and Conditions (“Terms”), including all incorporated policies, supplements, amendments, and appendices (collectively referred to as the “Agreement”). These Terms constitute a legally binding contract between you and ZetaCircle.

If you do not agree with any part of these Terms, including but not limited to the limitations on liability, jurisdictional clauses, disclaimers of warranties, or indemnification obligations, you must immediately cease all Use of the Site. Your continued Use constitutes your irrevocable consent to these Terms in their current form and as may be amended from time to time without prior notice. We reserve the right to modify, update, or replace any part of these Terms at our sole discretion. The revised terms will be posted on this page with an updated “Last Updated” date. Your continued Use after such changes constitutes acceptance of the revised Terms.

You further acknowledge and agree that:

ZetaCircle does not create, originate, or control the majority of content published on this platform;
Much of the content is contributed by third-party users, AI systems, web scrapers, automated bots, public data sources, and external API integrations;
ZetaCircle acts solely as an intermediary platform provider, not as a publisher, creator, or guarantor of any content, data accuracy, medical advice, financial projection, or AI-generated output;
The Site operates in a decentralized, open-content environment where legal and regulatory compliance is inherently complex due to global access;
No representation or warranty of any kind, express or implied, is made regarding the legality, accuracy, completeness, reliability, suitability, or timeliness of any information presented on ZetaCircle.com.
By using ZetaCircle.com, you represent and warrant that:

You are at least 18 years of age or the legal age of majority in your jurisdiction (whichever is higher);
You have full legal capacity to enter into this Agreement;
You will comply with all applicable local, national, and international laws, including but not limited to data privacy laws (GDPR, CCPA, PDPA, etc.), telecommunications regulations, medical advertising statutes, AI governance frameworks, and cross-border data transfer rules;
You will not use the Site for any unlawful, fraudulent, harmful, invasive, or unethical purpose;
You will not engage in data scraping of ZetaCircle’s platform for commercial resale or redistribution without express written permission;
You will not impersonate any person or entity, nor attempt to gain unauthorized access to systems or data;
You will not use the Site to disseminate malware, phishing content, spam, or any form of malicious code;
You will not interfere with the operation of the Site or attempt to overload its servers or APIs.
Failure to comply with any of these representations and warranties may result in immediate termination of your account, suspension of access, legal action, and/or reporting to relevant authorities.

2. DEFINITIONS
   For the purposes of this Agreement, the following terms shall have the meanings ascribed below:

“AI Content”: Any text, image, audio, video, data model, analysis, or recommendation generated by artificial intelligence systems (including but not limited to LLMs such as GPT, Claude, Gemini, or proprietary models), whether trained on public data, user inputs, or third-party datasets.
“User Content”: Any text, mobile numbers, images, documents, reviews, comments, articles, listings, medical advisories, geolocation data, cost projections, or other materials submitted, uploaded, posted, published, or otherwise made available by Users to the Site.
“Third-Party Content”: Any content sourced from external sources via web scraping, public APIs, government databases, open data repositories, or licensed feeds (e.g., WHO health data, telecom directories, public business registries).
“SaaS Store”: A customizable, AI-enhanced online storefront created by a User via ZetaCircle’s SaaS tools to sell goods, services, or digital products.
“Medical Advisory”: Any AI-generated statement, suggestion, diagnosis, treatment plan, or health recommendation presented on the Site. These are not licensed medical advice and do not constitute a doctor-patient relationship.
“Geolocation Data”: Any data derived from IP address, GPS coordinates, Wi-Fi triangulation, or mobile tower pinging used to determine a User’s physical location.
“Cookies and Tracking Technologies”: Small data files, pixels, beacons, scripts, SDKs, or similar technologies used to track User behavior, preferences, device identification, and session data.
“Payment Processor”: Any third-party entity (e.g., Stripe, Razorpay, PayPal) that processes payments made through the Site.
“API Services”: Application Programming Interfaces provided by third parties (e.g., Google Maps, Twilio, OpenAI, Azure Cognitive Services, medical data APIs) used to enhance functionality.
“Medical Tourism Facilitation”: The listing, promotion, or referral of healthcare providers, clinics, hospitals, or wellness centers located in foreign jurisdictions for the purpose of receiving medical treatment.
“Scraped Data”: Publicly accessible data collected automatically via web crawling, bots, or automated extraction tools from websites, directories, government portals, and other open sources.
“Platform”: ZetaCircle.com and all associated mobile applications, subdomains, APIs, backend systems, AI tools, dashboards, and integrated third-party services.
“Jurisdiction”: The city of Bengaluru, Karnataka, India; the sole and exclusive forum for any dispute arising under this Agreement.
“Commission-Based Sales”: Any transaction facilitated through SaaS Stores or affiliate programs where ZetaCircle earns a percentage fee based on sales volume.
“Liability”: Any loss, damage, cost, expense, claim, fine, penalty, or legal obligation arising from Use of the Site, including but not limited to financial loss, data breach, misinformation, medical harm, reputational damage, or regulatory violation.
“Indemnity”: The obligation of a party to compensate another for losses, damages, or liabilities incurred due to acts, omissions, or breaches.

3. OWNERSHIP AND INTELLECTUAL PROPERTY
   3.1 Ownership of the Platform
   ZetaCircle retains all rights, title, and interest in and to the Site, including but not limited to:

The design, structure, source code, algorithms, user interface, graphics, trademarks, logos, and branding;
The proprietary AI models, recommendation engines, cost projection algorithms, and medical analysis frameworks;
Databases of aggregated mobile numbers, geolocation data, and third-party content (to the extent permitted by law);
All intellectual property rights in software, patents, copyrights, trade secrets, and know-how.
You acknowledge that no ownership rights are transferred to you under this Agreement. You may not copy, reproduce, modify, distribute, license, sell, rent, reverse-engineer, decompile, disassemble, or create derivative works of the Site without prior written consent from ZetaCircle.

3.2 User Content Ownership
You retain all ownership rights to any User Content you submit, upload, or post. However, by submitting such content, you grant ZetaCircle a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to:

Use, reproduce, modify, adapt, translate, publish, display, distribute, perform, and otherwise exploit your User Content in any medium or format now known or hereafter developed;
Use your User Content for promotional, marketing, AI training, analytics, and optimization purposes;
Syndicate or redistribute your User Content to partners, affiliates, data aggregators, or search engines;
Combine your User Content with other datasets to improve AI models and services.
You hereby waive any moral rights (e.g., right of attribution or integrity) to the extent permitted by law. You represent and warrant that you have all necessary rights, licenses, consents, and permissions to grant this license. If your User Content includes personal data of third parties (e.g., mobile numbers, medical records), you affirm that you have obtained explicit, informed consent from those individuals and are in compliance with all applicable data protection laws.

3.3 AI-Generated Content Ownership
AI-generated content (e.g., articles, summaries, medical insights, cost projections) is considered the intellectual property of ZetaCircle. You may use such content for personal, non-commercial purposes only. Commercial reuse (e.g., publishing in a newsletter, reselling as an eBook, using for paid marketing) requires written permission from ZetaCircle. You agree that AI outputs are not guaranteed to be original, accurate, or free from bias, and ZetaCircle disclaims all ownership claims over derivative works created by Users based on AI outputs.

3.4 Third-Party Content
ZetaCircle does not claim ownership of any Third-Party Content displayed on the Site. We do not verify, endorse, or assume responsibility for the accuracy, legality, or copyright status of such content. If you believe any Third-Party Content infringes your intellectual property rights, please contact us at legal@zetacircle.com with a detailed notice. We will investigate and act in accordance with applicable copyright laws (e.g., DMCA, E-Commerce Directive).

3.5 Trademarks
All trademarks, service marks, logos, and trade names displayed on ZetaCircle.com are the property of their respective owners. Use of such marks without permission is strictly prohibited.

4. USER CONTENT AND MOBILE NUMBER LISTINGS
   4.1 Publication of Mobile Numbers
   ZetaCircle permits the publication, display, and indexing of mobile numbers submitted by Users. This includes both publicly listed contact information (e.g., business lines, customer service numbers) and privately submitted numbers. You understand and agree that:

Mobile number listings are not subject to prior verification by ZetaCircle;
The Site does not guarantee the accuracy, validity, or current status of any mobile number published;
Mobile numbers may be scraped from public directories, social media profiles, business websites, or user submissions;
You are solely responsible for ensuring that any mobile number you submit complies with all applicable telecommunications and data protection laws (e.g., TRAI DND Rules in India, TCPA in the US, PECR in the UK).
4.2 Consent and Compliance
By submitting a mobile number, you affirm that:

The individual associated with the number has provided explicit, informed consent for their contact details to be published on ZetaCircle.com;
The publication serves a legitimate, non-intrusive purpose (e.g., business contact, customer support);
You have not submitted numbers obtained via illegal means such as data breaches, hacking, or unauthorized scraping of private databases;
You will not use ZetaCircle to facilitate unsolicited marketing, telemarketing, or spam calls/texts.
If a mobile number owner wishes to have their number removed, they may submit a request via our Data Deletion Portal (https://zetacircle.com/delete) or email privacy@zetacircle.com. We will process such requests within 7 business days in accordance with applicable data subject rights under GDPR, CCPA, and other global privacy regimes. However, if the number was obtained from a public source or submitted by multiple Users, removal may not be possible due to the decentralized nature of our data architecture.

4.3 Liability for Misuse
ZetaCircle disclaims all liability for:

Unsolicited calls, SMS spam, phishing attempts, or harassment resulting from the publication of mobile numbers;
Misuse by third parties who access the directory (e.g., telemarketers, scammers);
Regulatory penalties imposed on Users for non-compliance with telecom regulations (e.g., DND registration in India);
Claims of invasion of privacy, defamation, or nuisance arising from mobile number listings.
You agree to indemnify ZetaCircle against all claims, fines, or legal actions arising from your submission of mobile numbers in violation of this provision.

5. AI-GENERATED CONTENT, INFORMATION, AND ENGAGEMENT
   5.1 Nature of AI Content
   ZetaCircle employs advanced artificial intelligence systems to generate articles, summaries, medical advisories, cost projections, and interactive responses. These outputs are not human-written and are generated based on statistical patterns derived from large datasets, including publicly available information, academic papers, news articles, and user inputs.

AI-generated content is provided solely for informational, educational, or exploratory purposes. It does not constitute professional advice in any field—medical, financial, legal, or otherwise.

5.2 Disclaimer of Medical Advice
AI-generated medical advisories (e.g., “Possible causes of headache,” “Recommended supplements for low iron,” or “Best hospitals in Thailand for heart surgery”) are:

Not a substitute for professional medical diagnosis, treatment, or advice;
Generated without knowledge of your personal health history, allergies, medications, or clinical condition;
Based on generalized population data and may contain inaccuracies, biases, or outdated information;
Not reviewed or approved by licensed medical practitioners.
By using any AI-generated health-related content, you acknowledge and agree that:

You are solely responsible for your health decisions;
ZetaCircle is not a healthcare provider, hospital, or medical institution;
You must consult a qualified physician before acting on any AI-generated health recommendation;
In no event shall ZetaCircle be liable for any injury, illness, misdiagnosis, or death resulting from reliance on AI medical content.
5.3 AI Engagement and Chatbots
ZetaCircle may provide interactive AI chatbots or virtual assistants to answer queries, recommend services, or generate content. These systems are trained on publicly available data and may occasionally produce:

Inaccurate or hallucinated responses;
Biased, offensive, or inappropriate outputs;
False or misleading cost projections;
You agree that any interaction with AI systems is at your own risk. ZetaCircle does not guarantee the correctness, completeness, or safety of AI-generated responses. We may monitor, filter, or disable AI interactions to prevent abuse, but we are under no obligation to do so.

5.4 AI Training and Data Usage
Your User Content (including messages, queries, uploaded documents) may be used to train and improve our AI models. This includes:

Aggregating data for model fine-tuning;
Improving natural language understanding and response accuracy;
Developing predictive models for cost projections and medical risk assessments.
You waive any claim to ownership or compensation regarding the use of your data for AI training. We do not store personally identifiable information (PII) in training datasets unless explicitly required for service functionality, and all data used for AI training is anonymized to the extent technically feasible.

5.5 AI Ethics and Bias
ZetaCircle is committed to responsible AI development but acknowledges that bias, stereotyping, or inaccuracies may exist in AI outputs due to limitations in training data. We do not guarantee neutrality, fairness, or objectivity in AI-generated content. You agree that ZetaCircle shall not be held liable for any adverse impact arising from AI bias, including but not limited to discrimination in health recommendations, economic projections, or job-related advice.

6. SaaS ONLINE STORES AND COMMISSION-BASED SALES
   6.1 Store Creation and Operation
   ZetaCircle provides SaaS tools enabling Users to create, customize, and operate their own online stores (“SaaS Stores”) for the sale of goods or services. You are solely responsible for:

Product descriptions, pricing, inventory management;
Compliance with product safety regulations (e.g., FDA, CE marking, RoHS);
Tax collection and remittance;
Shipping logistics and fulfillment;
Customer service and dispute resolution.
ZetaCircle does not act as a merchant, distributor, or insurer of products sold via SaaS Stores.

6.2 Commission Structure
ZetaCircle may charge a commission (ranging from 5% to 20%, depending on category) on sales generated through SaaS Stores. Commission rates are subject to change with 30 days’ notice posted on the platform. Commissions are deducted automatically from payment settlements.

You agree that:

ZetaCircle has no liability for product quality, delivery delays, or customer complaints;
We are not a party to any transaction between you and your customers;
You are solely liable for all obligations arising from sales conducted via your SaaS Store, including product liability, warranty claims, and consumer protection violations.
6.3 Payment Processing
All payments are processed through third-party payment processors (e.g., Stripe, Razorpay, PayPal). ZetaCircle does not store your customers’ credit card information. We are not responsible for:

Payment failures, fraud, chargebacks, or disputes;
Errors by the payment processor;
Currency conversion fees or bank delays.
You agree to indemnify ZetaCircle against any losses arising from payment-related issues on your SaaS Store.

6.4 Prohibited Items
You may not sell the following via your SaaS Store:

Prescription medications, controlled substances, or unapproved medical devices;
Counterfeit goods or unauthorized replicas;
Illegal drugs, weapons, explosives, or hazardous materials;
Stolen data, personal information, or identity documents;
Pornographic or sexually explicit content;
Gambling services or online casinos;
Items violating intellectual property rights.
Violation of this provision may result in immediate termination of your SaaS Store and reporting to law enforcement authorities.

6.5 Medical Tourism Listings
If your SaaS Store promotes medical tourism services (e.g., cosmetic surgery in Thailand, dental implants in Hungary), you must:

Disclose the full name and license status of each healthcare provider;
Clearly state that ZetaCircle is not affiliated with any clinic or hospital listed;
Include a disclaimer: “Medical tourism involves inherent risks. Consult your local physician before traveling for treatment.”;
Comply with all destination country regulations regarding medical advertising.
ZetaCircle assumes no responsibility for patient outcomes, malpractice claims, or travel-related incidents. You agree to indemnify us against all liabilities arising from medical tourism listings.

7. GEOLOCATION, DATA COLLECTION, AND COOKIES
   7.1 Geolocation Services
   ZetaCircle uses geolocation technologies to enhance user experience, personalize content, and optimize AI responses. We may collect:

IP address;
GPS coordinates (if enabled on mobile devices);
Wi-Fi network names and MAC addresses;
Cell tower IDs;
Time zone and language preferences.
This data is used to:

Display region-specific content (e.g., local medical clinics, cost projections for your country);
Enforce regional restrictions (e.g., blocking access to restricted services);

We implement industry-standard security measures (encryption at rest and in transit, access controls, regular audits) to protect data. However, no digital system is 100% secure. We make no warranty that your data will be immune from breaches, hacks, or unauthorized access.

7.3 Cookies and Tracking Technologies
ZetaCircle uses a variety of cookies and tracking technologies to:

Maintain user sessions;
Remember preferences (e.g., language, currency);
Analyze traffic patterns and improve Site performance;
Deliver targeted advertising (if applicable);

Twilio: For SMS notifications and mobile number verification;
OpenAI / Anthropic: For AI content generation;
Stripe / Razorpay: For payment processing;
PubMed / MedlinePlus: For medical research data;

Cloudflare / AWS / Azure: For hosting, CDN, and security services.
These APIs are subject to their own terms of service. ZetaCircle has no control over their availability, accuracy, pricing changes, or data handling practices.

8.2 Disclaimer of API Liability
You agree that:

ZetaCircle is not liable for API downtime, rate limits, data errors, or sudden termination of service by third parties;
AI-generated medical advisories may rely on outdated or incorrect data from public health APIs;
Geolocation inaccuracies due to Google Maps API errors are not our responsibility;
Payment failures due to Stripe outages do not constitute a breach by ZetaCircle.
We shall not be held liable for any damages resulting from the failure, inaccuracy, or discontinuation of any third-party API.

8.3 Cloud Infrastructure and Hosting
Our platform is hosted on Amazon Web Services (AWS), Google Cloud Platform, and Microsoft Azure. These providers may store data in multiple regions. We follow ISO 27001 and SOC 2 compliance standards for infrastructure security.

You acknowledge that cloud providers may be subject to government data access requests (e.g., CLOUD Act in the U.S.). We will notify you if legally permitted to do so.

8.4 Embedded Content and Widgets
ZetaCircle may embed content from third-party platforms (e.g., YouTube videos, Twitter feeds, Instagram carousels). These elements are governed by the terms of their respective owners. Clicking on such content may expose you to third-party tracking, advertising, or data collection practices beyond our control.

9. MEDICAL ADVISORIES AND AI-BASED HEALTH INFORMATION
   9.1 Nature of Health Content
   All medical advisories, health summaries, treatment comparisons, and AI-generated wellness tips are generated without consultation with licensed physicians. They are intended for general informational purposes only and must not be construed as:

A diagnosis;
A recommendation to start, stop, or modify any medication;
A substitute for professional medical care.
9.2 Disclaimer of Medical Liability
ZetaCircle expressly disclaims all liability for:

Misdiagnosis or delayed diagnosis due to reliance on AI-generated health content;
Adverse reactions from following supplement recommendations;
Harm caused by self-treatment based on AI suggestions;
Inaccurate or outdated medical statistics from public databases;
Errors in cost projections for international medical procedures.
You agree that:

You are solely responsible for verifying any health information with a licensed healthcare provider;
ZetaCircle does not offer telemedicine services or prescribe medications;
No doctor-patient relationship is formed through use of the Site.
9.3 Medical Tourism Disclaimers
If ZetaCircle lists foreign clinics, surgeons, or hospitals:

We do not verify their credentials, licensing, or safety records;
We are not affiliated with any facility listed;
Costs quoted may be estimates and do not include travel, visas, or post-op care;
You assume all risks associated with cross-border medical procedures.

You agree that:

11. USER OBLIGATIONS AND PROHIBITED ACTIVITIES
    You agree not to:

Scrape, crawl, or harvest data from ZetaCircle.com without written permission;
Use automated bots to generate fake listings, reviews, or mobile number submissions;
Attempt to reverse-engineer the platform’s AI models or algorithms;
Submit false, misleading, or fraudulent information;
Use the Site to harass, threaten, or intimidate others;
Post content that is obscene, defamatory, pornographic, racist, or discriminatory;
Violate any third-party rights (copyrights, trademarks, privacy);
Engage in money laundering, fraud, or illegal gambling;
Use the Site to distribute malware, phishing links, or ransomware;
Create multiple accounts to circumvent restrictions;
Use the Site for any illegal purpose under local, national, or international law.
Violations may result in account suspension, legal action, and reporting to authorities. ZetaCircle reserves the right to investigate and cooperate with law enforcement.

12. LIABILITY LIMITATIONS AND DISCLAIMERS
    12.1 No Warranty

Our total cumulative liability under this Agreement shall not exceed the amount paid by you to ZetaCircle in the 12 months preceding the claim.

12.3 Exclusion of Liability for Third-Party Content
We are not responsible for the actions, omissions, or content of Users, third-party websites, AI systems, API providers, or scrapers. We do not monitor content in real time and cannot be held liable for unforeseeable or unsupervised User behavior.

12.4 AI and Automation Risk
AI systems are inherently probabilistic, non-deterministic, and prone to errors. By using AI features, you assume all risks associated with automated decision-making systems, including but not limited to:

Algorithmic bias;
Hallucinations or fabricated facts;
Privacy violations via data inference;
Discriminatory outputs.
You waive any claim for damages arising from AI failures.

13. INDEMNIFICATION
    You agree to defend, indemnify, and hold harmless ZetaCircle, its officers, directors, employees, agents, affiliates, contractors, and third-party service providers from and against any and all claims, liabilities, damages, losses, costs (including reasonable attorneys’ fees), fines, or penalties arising from:

16.2 Refunds
Refunds may be granted only if:

A service was not delivered as promised;
A payment was processed in error;
We issue a refund at our sole discretion.
No refunds are provided for:

16.3 Taxes

You irrevocably submit to the jurisdiction of the courts in Bengaluru and waive any objection based on venue or forum non conveniens.

19. DISPUTE RESOLUTION
    Before initiating litigation, you agree to attempt informal resolution via written notice to legal@zetacircle.com. If unresolved within 30 days, you may file suit exclusively in the courts of Bengaluru.

Class actions, representative actions, and jury trials are expressly waived. All disputes shall be resolved individually.

20. MISCELLANEOUS
